AG Moody: U.S. Border Bill a “Mirage”

Yesterday, as part of a coalition with fifteen other states, Attorney General Ashley Moody objected to the United States Senate’s proposed border supplemental bill introduced in Congress this week.

“This bill is a mirage,” Moody said. “It codifies many of the illegal actions President Biden has already taken. The President caused this crisis, and the fact is, he could begin strengthening the border tomorrow by simply enforcing the law.”

Unlawful and Reckless Border Policies

In a new letter released today, Moody calls on Florida Senators Marco Rubio and Rick Scott to oppose the bill, citing Florida’s extensive litigation against the Biden Administration’s “unlawful and reckless border policies.”

“The goal of that litigation has been to force the Biden Administration to follow the law,” Moody wrote.

In one case, a federal district court judge concluded that the Biden Administration “ha[s] effectively turned the Southwest Border into a meaningless line in the sand and little more than a speed bump for aliens flooding into the country by prioritizing ‘alternatives to detention’ over actual detention and by releasing more than a million aliens into the country on ‘parole’ or pursuant to the exercise of ‘prosecutorial discretion’ under a wholly inapplicable statute-without even initiating removal proceedings.”

Existing Laws Not Enforced

Moody said it’s important to recognize that federal immigration law is the same as it was during the Trump Administration. But the existing law is not being fully or faithfully executed by the President, Secretary Mayorkas, or any other official in the Biden Administration.

“A bill defining when and how those [immigration] laws can be ignored isn't a border security bill,” said Senator Marco Rubio on X, later commenting that the bill is an “easy NO” and that it reads "like a parody of an actual border security bill.”

U.S. immigration law currently provides the tools necessary to eliminate incentives for aliens to come to the country, eliminate policies that allow them to stay in the country, and deport those who enter illegally.

Even if members of Congress believe new laws need to be passed to control the flow of illegal aliens into the Southern border, Moody says those laws require meaningful accountability and oversight – something the proposed legislation does not provide.
